Basic Payment Scheme Payments

643. Deputy Éamon Ó Cuív asked the Minister for Agriculture, Food and the Marine the reason the full payment is held back from farmers on their direct farm payments when small issues arise even when an interim payment is being made; if it is intended to review this policy; and if he will make a statement on the matter. Advance payments under the Basic Payment Scheme (BPS) commenced in Ireland on 17 October 2016 in respect of applicants whose applications are fully processed and who have no outstanding errors. This is the earliest that payments can commence under the governing EU Regulations.

To date payments in excess of €791m have issued to over 120,000 applicants. Regular payment runs are being made in respect of all applicants whose applications are fully processed and who have no outstanding errors.

The processing of applications under the Basic Payment Scheme is a complex administrative task and one that remains a top priority for my Department. The scheme is fully funded by the European Union and the relevant Competent Authorities in each Member State are obliged to ensure that the requirements of the governing EU Regulations are observed and that only valid applications that fully comply with the requirements are paid.

The administration of the scheme in each Member State is subjected to close scrutiny by officials of the EU Commission and the EU Court of Auditors to ensure that the regulatory requirements are met and that the Schemes are applied in a uniform manner across the European Union.

All applications under the Scheme are subject to administrative checks, with a further 5% also subject to land eligibility inspections in compliance with EU legislation.

Where issues preventing payment are identified contact is made with the applicant concerned in order to resolve the query. Work is well underway in resolving the queries that have arisen following these checks and farmers are being contacted as necessary.

I am keenly aware that the advance payment of the BPS is a vital support to farmers across sectors in maximising cash flow and my Department will continue to prioritise the processing of all outstanding cases.

In order to draw down payment under the Basic Payment/Greening Scheme an applicant  must have an “eligible hectare” to accompany each entitlement held. In this context, the definition of an “eligible hectare” is land that is used for an agricultural activity and it also includes maintaining an agricultural area in a state suitable for grazing or cultivation. More specifically an ‘Agricultural Activity’ means:

a) The production, rearing or growing of agricultural products, including harvesting, milking, breeding animals, and keeping animals for farming purposes.

b) Maintaining an agricultural area in a state suitable for grazing or cultivation.

Maintenance can be achieved by topping, keeping the hedgerows maintained and by preventing the development of scrub and maintaining drains.  In 2015 my Department  produced a very detailed Guide to Land Eligibility, which has been provided to all Basic Payment Scheme payment applicants. This guide gives clear and concise guidance on what is expected of farmers and includes examples of cases where the level of maintenance is such that the land can be deemed eligible.

Deputy Éamon Ó Cuív asked the Minister for Agriculture, Food and the Marine the total pay out to date under the GLAS and GLAS plus scheme for 2015; the number of farmers that have received their full payment of 2015; the number that have received 85% payment and the number that have received no payment; the number of farmers that joined GLAS in 2015; and if he will make a statement on the matter. A total of €17,061,884 has issued to date under the GLAS Scheme in respect of the 2015 scheme year. There are 25,622 farmers currently approved in the first tranche of GLAS (GLAS 1). Some 22,162 of these participants are due a 2015 payment in respect of the three month period October to December 2015. The balance of farmers approved in GLAS 1, some 3,460 farmers, are not due a payment for 2015 as they either have a commencement date of 1 January 2016 or did not have  any GLAS payable actions for 2015 in their applications.

To date 20,333 GLAS 1 farmers have received their full 2015 part year payment while an additional 1,197 applications have received the first instalment  of their 2015 payment representing up to 85 % of total due for 2015. There are 632 applications which have yet to receive any payment for 2015 as they have not successfully completed the required regulatory checks due to errors identified during the Basic Payment Scheme cross checks, inspection cases that are currently being finalised, mismatches in Land Parcel Identifications System numbers due to changes in parcel boundaries and applications to change the areas originally approved into the scheme. Staff in my Department are continuing to work on all outstanding applications on a case by case basis with the intention of processing payments which meet all required regulatory requirements as soon as possible.

The GLAS Scheme includes a measure which provides support for farmers to manage their commonage lands. For commonage farmers who wish to join GLAS, the Scheme requires the development and implementation of a GLAS Commonage Management Plan (CMP) which must be prepared and completed by a trained and qualified Agricultural Advisor. The Advisor is paid by the farmer and is not working for the Department. The price paid is a matter between the farmer and the Advisor

My Department did not set any rules or guidelines in relation to professional fees involved in joining GLAS. Under the GLAS Scheme payment to farmers in respect of commonages was increased from €79 per hectare under the previous agri-environment measure to €120 per hectare per annum for five years to take account of potential additional costs to the farmer.

Under Section 2 of the Agriculture Appeals Act 2001 the Minister may appoint such and so many of his or her officers or, following selection at competitions held by the Public Appointment Service, other persons holding positions within the Civil Service, as he or she considers appropriate, to be appeals officers for the purposes of this Act.

Section 6 of the Agriculture Appeals Act 2001 places a statutory obligation on Appeals Officers to be independent in the performance of their functions. Appeals Officers are fully aware of their legal obligations in that respect.

The Programme for a Partnership Government includes a commitment to review the Agriculture Appeals Act 2001 to ensure the independence and efficiency of the Office in dealing with appeals from farmers. Consultations are due to commence shortly in that regard.

The person named submitted a 2016 Basic Payment Scheme (BPS)/Areas of Natural Constraint (ANC) Scheme application on 5 May 2016. EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases on-farm inspections, be completed before any payments issue.

The application of the person named was selected for a ground eligibility inspection. This inspection has been completed, with the island land in question having been inspected on 23 November 2016. The outcome of the inspection will now be processed to finalisation and in the event of any non-compliances being identified the person named will be notified of these shortly.  

On completion of this process any payments due under the BPS and ANC Schemes will issue to the nominated bank account of the person named as soon as possible.

EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases remote sensing (i.e. satellite) inspections, be completed before any payments issue.

The application of the person named was selected for a remote sensing eligibility inspection. This inspection is currently being processed with the intention of issuing any payments due as soon as possible. In the event that any queries arise officials in my Department will be in contact with the person named.
