747. Deputy Joan Burton asked the Minister for Jobs, Enterprise and Innovation if she will undertake a full review of the rights of artists here including a thorough examination of existing copyright laws and the current Competition Act. [37073/16]

In my most recent answer to Parliamentary Question No. 294 to the Deputy on 20 October, I advised on progress in relation to the proposed Bill on copyright for which Government approved the Heads of Bill in July 2016. The main purpose of the proposed Bill is to respond to certain of the recommendations contained in a Report undertaken by the Copyright Review Committee entitled “Modernising Copyright” which was published in October 2013. The Bill does not involve a thorough examination of copyright legislation in its entirety or indeed of the rights of artists. In general, the rights of artists come within the overall policy responsibility of the Minister for the Arts, Heritage, Rural and Gaeltacht Affairs.

As advised, the Bill is currently undergoing the formal drafting process with the Office of the Parliamentary Counsel and that remains the position.

Artists who are employees in Ireland have the same rights as all other employees. In cases of self-employed artists, as with other self-employed workers, the application of competition law would only be a consideration if there are allegations of anti-competitive behaviour.

I propose to take Questions Nos. 748 to 751, inclusive, together.

Opportunities for staff to apply for secondments are offered in line with the business needs of the Department and the wider Civil Service, and also serve to provide a range of broader developmental interests for the staff concerned. Appeals against secondments have not been an issue for my Department.

No secondments to the private sector have taken place to/from my Department within the relevant period, however, activities and initiatives to enhance mutual understanding between the private and public sector are welcomed by my Department to further inform policy and decision making. Staff of my Department participate in a wide range of secondments, including to the EU institutions in Brussels both to utilise their expertise and corporate knowledge, and to further develop their skills to the benefit of the staff concerned, the Department and the overall Civil Service.

Details of the number of staff of my Department on secondment to other Departments or Agencies during 2010-2016 are as set out in the following table.

There are currently two vacancies on State Boards that come within my Department's remit, both of which are on the Board of IAASA. In this regard, there is one position for a Chairperson, for which a shortlist was recently submitted by the Public Appointments Service (PAS) to me. The selected candidate is now to meet with the Joint Oireachtas Committee for Jobs, Enterprise and Innovation before I conclude the appointment process. The second vacancy, a Ministerial nominee, will be filled following public advertisement and recruitment process conducted by PAS.

I propose to take Questions Nos. 753 to 755, inclusive, together.

My Department is focused on ensuring that the effects of economic recovery are felt throughout all regions of the country. While employment has increased in all our regions, it has not been as fast in some. The Government’s ultimate target is to achieve sustainable full employment, and to assist in achieving this objective, my Department’s agencies are ensuring that targeted supports for enterprise and job creation are provided throughout all regions. The Action Plan for Jobs for the North West/North East region, which includes Louth, sets out a comprehensive plan to build on the strengths of the region to develop its full potential for enterprise and jobs growth.

Details of funding for projects in County Louth in 2014, 2015 and 2016 provided by the agencies of my Department are set out in the following tables where available. The levels of funding to be provided for projects in 2017 have not yet been determined.

IDA Ireland

IDA Ireland continues to work towards achieving job creation and investment targets set out in its strategy ‘Winning Foreign Direct Investment 2015-2019’, and is particularly focusing on job creation outside Dublin. In 2016 the following project announcements were made in relation to IDA Ireland companies in Louth. Details of grant payments in 2016 are not yet available.

Local Enterprise Offices

Capital funding from my Department for Local Enterprise Development is allocated to the Local Enterprise Offices (LEOs) through the Centre of Excellence in Enterprise Ireland. This funding is allocated among the LEOs to support clients through the provision of grants (Measure 1) and soft supports (Measure 2), such as training and mentoring, and used to fund the Ireland’s Best Young Entrepreneur (IBYE) programme. Details of the total payments made by LEO Louth in 2014 and 2015 are set out in Table 1. Details of total payments made in 2016 are not available.

Deputy Pearse Doherty asked the Minister for Jobs, Enterprise and Innovation if plans are being considered to amend the Organisation of Working Time Act 1997, concerning Sunday premiums and supplemental provisions in order to provide greater clarity to both workers and employers as to the definition of reasonable paid allowances, pay increases and-or paid time off work; and if she will make a statement on the matter. I have no plans to amend the provisions of the Organisation of Working Time Act related to Sunday premiums.

Section 13(5) of the Organisation of Working Time Act 1997 provides that the weekly or fortnightly rest period for employees must include a Sunday unless the contract of employment includes a specific provision requiring the employee to work on a Sunday. Section 14 of the Act provides that an employee who is required to work on a Sunday is entitled to a premium for Sunday work in circumstances where the requirement to work on a Sunday has not already been taken account of in the determination of an employee’s pay. The method for determining the premium to be paid is set out in Section 14.

An employee can seek redress in relation to section 14 by making a complaint to the Adjudication Service of the Workplace Relations Commission (WRC). In circumstances where WRC Inspectors, in the course of the inspection of employment records, become aware of, or suspect, a possible failure to comply with the provisions relating to the payment of Sunday premium, the employer concerned is advised of their obligations and employees are advised of the avenues of redress open to them.

The appointment of Special Advisers to my Department is governed by “Instructions” issued by the Department of Public Expenditure and Reform (DPER) and requires the approval of Government.

Within those guidelines, I currently have one Special Adviser reporting directly to me and the Guidelines allow for two.

In addition, my colleague, Minister of State John Halligan, T.D, has recently received approval to appoint a Special Adviser. However, for administrative reasons, Minister of State Halligan appears on the staffing complement of the Department of Educations and Skills where he is also assigned and, therefore, his Special Adviser will be on the payroll of that Department also.
