636. Deputy Michael Fitzmaurice asked the Minister for Agriculture, Food and the Marine the reason a person's file (details supplied) has not been sent from his Department to the Agriculture Appeals Office despite numerous requests from the appeals office; and if he will make a statement on the matter. An application under the 2015 Areas of Natural Constraints (ANC) scheme was received from the person named on 29 April 2015.  On processing of the application it was identified that not all scheme eligibility criteria were met, resulting in a rejection of the application for payment.  At that point additional correspondence was submitted by the person named, which on examination was not sufficient to overturn the original decision.  The applicant was advised of this position and of his right to seek a review from the Agricultural Appeals Office. 

When seeking this review the person named submitted new additional information which necessitates a re-examination of the original decision.  This examination is ongoing at present with a view to advising the Appeals Office of the most up to date position at the earliest stage possible.
