Deputy Bríd Smith asked the Minister for Arts, Heritage, Regional, Rural and Gaeltacht Affairs the pending fines or possible prosecutions against the State for breaches of EU wildlife protection law and destruction of protected habitats; and if she will make a statement on the matter. No such fines are pending and while there are some infringement cases open against Ireland (“Birds Case” C-418/04 and Reasoned Opinions from the European Commission on Bogs/Turf Cutting and on SAC Designations) there are no cases before the Court of Justice of the European Union.
