Deputy Seán Haughey asked the Minister for Employment Affairs and Social Protection the position regarding the drafting of legislation to exclude compensation awards arising from a tragedy (details supplied) as means for social welfare payments; and if she will make a statement on the matter. Social welfare legislation provides for the disregard of certain compensation awards when assessing the means of a person for social assistance means testing purposes.

My Department is currently considering the appropriate legislative amendments for disregarding awards from the Stardust compensation scheme.

It should be noted that any such awards have been disregarded on an administrative basis since 15 December 2016 and accordingly, no such payments will be assessed as means for social welfare means testing purposes.
