Deputy Catherine Connolly asked the Minister for Children and Youth Affairs the consequences facing crèches found to be non-compliant with the legislative requirement to only hire persons with a minimum FETAC level five; if conditions will be attached to their registration; if so, the conditions; and if she will make a statement on the matter. I can confirm that on inspection a service which employs staff without the relevant qualifications will be found non compliant with Regulation 9(4). A condition will be attached to that service that all staff working directly with children must have the relevant qualification and the registered provider is afforded the opportunity to make representations as to how this will be addressed. Each representation is assessed on its own merits on a case-by-case basis.
