Deputy John McGuinness asked the Minister for Health the number of freedom of information requests received by his Department to date in 2017; the number of which the period of consideration was completed within four weeks of the receipt of the request; and the number of which the period of consideration was extended by up to four weeks in view of the fact that the necessary resources to complete the request within the original timeframe were not available, in tabular form. The number of Freedom of Information requests received in my Department, to date in 2017, is 335.

The Department's Freedom of Information request Tracker System does not currently generate reports setting out the number of requests which have been completed within the legislative time-frame. Neither does it generate the number of requests on which Section 14 extensions were sought. I would like to point out that Section 14 extensions are only sought where the request relates to such number of records or the number of other FOI requests relating either to the record or records to which the specified request relates that compliance with the 20 working day time-frame is not reasonably possible.

Under the Health (Pricing and Supply of Medical Goods) Act 2013, the HSE has statutory responsibility for the pricing and reimbursement of the community drug schemes; therefore, the matter has been referred to the HSE for attention and direct reply to the Deputy.

Health Services Reform

The report of the cross-party Committee on the Future of Healthcare made a broad range of recommendations and envisages considerable change and reform across health and social care services. I am currently considering these recommendations and the actions required to support implementation as part of wider consideration of the Sláintecare report. I expect to present a response to the report along with a proposed implementation plan to Government later this month. This will set out our ambitions for the next decade and concrete plans for the immediate years ahead.

The Sláintecare report provided costs for a range of actions recommended in the report. Further analysis of potential future costs, in as far as is possible, is also being undertaken in the context of the development of the Sláintecare implementation plan. However, it is important to state that the process underway could not, and should not, seek to be definitive in terms of a cost benefit analysis of a full 10 year reform programme. The reform plans envisaged in the Sláintecare report will be a significant undertaking and need to be translated into a concrete and phased programme of work, supported by strong implementation structures and processes and a clear implementation plan. A core feature of this plan will be a process that enables detailed costings of actions in advance of implementation and robust monitoring and implementation frameworks to ensure reforms are delivering desired outcomes.

This detailed work will be overseen by a Reform Programme Office. As the Deputy is aware, the Government agreed to move forward with the establishment of a dedicated programme office during the summer, and specifically the recruitment of a Lead Executive for that Office. This marks a critical first step in gearing up for a significant programme of reform and demonstrates the Government’s commitment to this process. €1 million has been allocated to this Office in 2018 in line with the report's recommendation.

The recruitment process for the Head of this Office is underway and is being managed by the Public Appointments Service. It is essential that we are positioned to attract candidates of calibre for what will be a considerable reform programme. An extensive national and international executive search is being undertaken as a first step in this recruitment process, with the aim of attracting very senior candidates with a strong track record in implementing large scale programmes of reform. This will be followed by a public advertisement process.

This commitment is outlined in the Programme for Partnership Government, which is guided by two principles: equality of opportunity and improving the quality of life for people with disabilities.

The Health Service Executive has statutory responsibility for decisions on pricing and reimbursement of medicines under the community drug schemes, in accordance with the Health (Pricing and Supply of Medical Goods) Act 2013.

The HSE informed my Department of its decision not to reimburse Ataluren (Translarna) in July 2017. The HSE, in deciding not to reimburse Translarna, cited uncertainty around clinical evidence but advised the applicant that it would be open to reviewing any additional clinical evidence if any should become available. The HSE informed the applicant of this decision, in keeping with the requirements of the 2013 Act. The applicant has appealed the HSE’s decision to the High Court, which is part of the statutory process under Section 27 of the 2013 Act.

As proceedings have now issued against the HSE, this is now subject to the Courts process.

It would be inappropriate for me to comment on a matter currently before the Courts.

I understand that the report has now been received by Social Care division and will be considered over the coming period. Any proposals for changes to the approved Capital Investment Programme for Community Nursing Units would have to be considered in the context of capital funding available to Health, potential revenue implications and compliance with the agreed capital approval process.
