1373. Deputy Michael Healy-Rae asked the Minister for Employment Affairs and Social Protection the status of a carer's allowance application by a person (details supplied); and if she will make a statement on the matter. [14970/18]

Carer's Allowance (CA) is a means-tested payment, made to a person providing full-time care and attention to a child or an adult who has such a disability that they require that level of care.

An application for CA was received from the person concerned on 25 October 2017.

It is a condition for receipt of CA that the carer's means must be less than the statutory limit.

It is a further condition that the carer must provide full-time care and attention and that if the carer is employed outside the home, the hours of employment cannot exceed 15 hours per week.

The application was disallowed on the grounds that the carer did not satisfy any of these conditions.

The person concerned was notified on 14 March 2018 of this decision, the reason for it and of her right of review and appeal.

Carer's allowance (CA) is a means-tested social assistance payment made to a person who is habitually resident in the State and who is providing full-time care and attention to a person who has such a disability that they require that level of care.

CA was awarded to the person concerned on 27 February 2018 and the first payment issued to her nominated bank account on 4 March 2018.

Arrears of allowance due from to 16 November 2017 have also issued. The person concerned was notified of these details on 27 February 2018.

I confirm that my department received an application for CA from the person concerned on the 23 February 2018.

Additional information was requested from her on 6 April 2018. Once the information is received the application will be processed and she will be notified directly of the outcome.

An application for Carer's allowance (CA) was received from the person concerned on 25 September 2017.

The evidence submitted in support of this application was examined and the deciding officer decided that although a certain level of care was being provided the level involved did not amount to full-time care.

The person concerned was notified on 13 March 2018 of this decision, the reason for it and of his right of review and appeal.

An application for carer's allowance (CA) was received from the person concerned on 12 July 2017.

It is a condition for receipt of CA that the person concerned must be providing full-time care and attention.

The evidence submitted in support of this application was examined and the deciding officer decided that the evidence did not indicate that this condition was satisfied.

The person concerned was notified on 13 October 2017 of this decision, the reason for it and of her right of review and appeal.

My department were notified on 10 November 2017 that the person concerned had appealed this decision to the Social Welfare Appeals Office (SWAO). A submission in support of the decision was forwarded to the SWAO on 21 November 2017.

On 23 February 2018 the SWAO notified the person concerned that their appeal was disallowed.

Under Social Welfare legislation, the decision of an Appeals Officer is final and conclusive and may only be reviewed in the light of relevant additional evidence or new facts.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 8 March 2018. It is a statutory requirement of the appeals process that the relevant papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought from the Department of Employment Affairs and Social Protection. These papers have been received in the Social Welfare Appeals Office on 15 March 2018 and the case will be referred to an Appeals Officer who will make a summary decision on the appeal based on documentary evidence presented or, if required, hold an oral hearing.

The Social Welfare Appeals Office functions independently of the Minister for Employment Affairs and Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.

An application for carer's allowance (CA) was received from the person concerned on 24 January 2018.

It is a condition for receipt of a CA that the person being cared for must have such a disability that they require full-time care and attention.

This is defined as requiring from another person, continual supervision and frequent assistance throughout the day in connection with normal bodily functions or continual supervision in order to avoid danger to him or herself and likely to require this level of care for at least twelve months.

The evidence submitted in support of this application was examined and the deciding officer decided that this evidence did not indicate that the requirement for full-time care was satisfied.

The person concerned was notified on 26 March 2018 of this decision, the reason for it and of his right of review and appeal.

I can confirm that my department received an application for disability allowance (DA) from this gentleman on 18 January 2018.

On 10 April 2018 the person concerned was requested to supply supporting documentation required by the deciding officer in order to make a decision on his eligibility.

On receipt of this information a decision will be made on his DA application and the person concerned will be notified of the outcome.

I confirm that an application from this lady for disability allowance (DA) was received by the Department on 29 January 2018.

The processing time for individual DA claims may vary in accordance with their relative complexity in terms of the three main qualifying criteria, the person’s circumstances and the information they provide in support of their claim.

The application has been referred to a Social Welfare Inspector (SWI) for a report on the person's means and circumstances. Once the SWI has submitted his/her report to DA section, a decision will be made on the application and this lady will be notified directly of the outcome.

This gentleman was in receipt of another social welfare payment, or an increase was paid to another for his benefit, during the period 15 November 2017 to 20 March 2018. Consequently, the amount of social welfare already paid required calculation and was deducted from any arrears due. The figure deducted from arrears due did not include any additional amounts for fuel allowance or for living alone allowance.

This process was completed by my department as quickly as possible. Disability allowance arrears issued to the person in question on 27 March 2018.
