284. Deputy Mattie McGrath asked the Minister for Health the assistance that can be offered to a person (details supplied) who is seeking compensation for medical negligence as a result of being fitted with a faulty hip implant in 2007; and if he will make a statement on the matter. [51545/18]

An alternative dispute resolution (ADR) process was put in place by the Courts in late 2015. This means that any person seeking compensation on foot of being fitted with the recalled DePuy ASR hip resurfacing device or DePuy ASR XL total hip replacement implants must now pursue their case through this process in the first instance. Details of how to access this process are available at hipadr.ie. I have been informed by the State Claims Agency that if a settlement is not agreed through this process, the claimant can then pursue their claim through the courts. A solicitor is not required to apply to the ADR scheme.
