218. Deputy Jan O'Sullivan asked the Minister for Business, Enterprise and Innovation when a hearing will be held in the Labour Court in relation to an unfair dismissals case (details supplied); and if she will make a statement on the matter. [28395/19]
View answerThe Labour Court is an independent statutory office under the aegis of my Department. The Court was established under the Industrial Relations Act, 1946. Its functions have been altered and extended by subsequent legislation, including, most recently, the Workplace Relations Act 2015. Under the 2015 Act, the Labour Court assumed the role of sole appellate body in disputes under employment rights legislation.
The Labour Court operates as an independent adjudicative body in carrying out its statutory function and as such it is not appropriate for me to comment on the detail of an individual case which may be before the Labour Court.
