188. Deputy Aodhán Ó Ríordáin asked the Minister for Education if the review of the ex gratia scheme set up in the wake of a case (details supplied) and judgments in the European Court of Human Rights and in the Irish courts has been completed; if it has or will be published; if the report on Irish progress on implementation of the judgment due to the Council of Europe on 8 December 2020 has or will be published; the contents of reports and reviews on the case; and if she will make a statement on the matter. The ex gratia scheme, was established in 2015 to provide an effective remedy for a specific category of people, namely those persons who had commenced domestic litigation but who had discontinued those proceedings following High Court and Supreme Court judgments and because of this discontinuation had no domestic remedy. The review of the scheme has yet to be concluded.

As part of the implementation of the ECtHR judgment, the State has to file action plans with the Council of Europe. All of the action plans including the one submitted on 8 December are published on my Department's website.
