Deputy Jim O'Callaghan asked the Minister for Health when it is intended to legislate in the area of assisted human reproduction; and if he will be doing so in line with the recently published report of the Special Rapporteur on Child Protection which recommends that the Government introduce a legislative framework including recognition of international surrogacy and parenting arrangements. As the Deputy will be aware, drafting of a bill on assisted human reproduction (AHR) and associated areas of research is ongoing by officials in my Department, in conjunction with the Office of the Attorney General. This comprehensive piece of legislation will encompass the regulation, for the first time in Ireland, of a very wide range of practices, including domestic altruistic surrogacy. I can assure the Deputy that publication of this legislation is a priority for my Department and the Government, and a commitment to enact this legislation is included in the Programme for Government, “Our Shared Future”. Officials in my Department and the Office of the Attorney General continue to prioritise the drafting of this complex legislation and will engage intensively over the next few months to finalise the Bill.

The published report of the Special Rapporteur on Child Protection comprises issues relating to parentage and the right to identity in donor-assisted human reproduction and surrogacy in this jurisdiction and abroad.

As issues relating to international surrogacy raised in the report of the Special Rapporteur concern areas of law that intersect across the remits of several Government Departments, my Department is engaging with the Department of Justice and the Department of Children, Equality, Disability, Integration and Youth in regard to this issue.

The HSE have advised my officials that this issue has been resolved and that the Digital Covid Certificate (DCC) for Mr. Kennedy will issue by close of business today, 15th September 2021.

Typically these issues arise where the complete dataset, which extends beyond the information provided, is not recorded on the national Covid vaccination system (COVAX) and hence the data is not available for the creation of a DCC.

General practice has continued to operate during the public health emergency and GPs are still seeing patients where necessary, albeit with infection-control measures in place. In response to the pandemic, it has been necessary to curtail patient in-person contact with GP surgeries as much as possible to help prevent the spread of the virus and for the protection of patients and staff.

Neither the Department of Health nor the HSE has issued guidance to general practitioners in relation to the provision of medical services to patients on the basis of their Covid vaccination status

It is expected that normal clinical practice should be accessible to all patients, in line with normal risk assessment procedures.

The EU Digital COVID Certificate Regulation (2021/953) allows Member States the option to issue vaccination certificates to EU citizens and family members vaccinated in third countries. Such persons do not have a right to receive a Digital COVID Certificate and it is up to each individual member state to decide if and how to provide such certificates.

Following the successful rollout of the initial implementation phase of the EU Digital COVID Certificate in Ireland, the Government has decided to create a specific portal to enable Irish citizens vaccinated outside of the EU, with vaccines authorised for use in Ireland, to obtain a COVID certificate valid in Ireland and across the EU.

This portal is currently being advanced on a cross departmental basis involving technical and process development, and resource management. It is expected that an announcement on the launch of this portal will be made shortly.

Under the EU regulation persons are entitled to request a Digital COVID Certificate stating they have received a single dose of vaccination in an EU Member State. Such requests can be made through the helpline.
