Deputy Catherine Connolly asked the Minister for the Environment, Climate and Communications the number and value all procurement contracts that took place by way of negotiated procedure without prior publication in 2020 and to date in 2021; and the date, value and purpose of each negotiated procedure contract in tabular form. View answerThe use of negotiated procedure without prior publication is permitted in specific circumstances where contracting authorities are unable to follow standard public procurement procedures and need to make direct awards to particular suppliers. In general, competitive tendering is used by my Department unless exceptional circumstances exist which justifies the use of an alternative approach. In accordance with Circular 40/2002, issued by the Department of Finance, my Department completes an annual return in respect of contracts above a €25,000 threshold which have been awarded without a competitive process. The Departments 40/02 report includes contracts awarded under the negotiated procedure without prior publication.
