Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.

I have contacted the HPRA in relation to the query raised by the Deputy. They advised that the medication, Petinimid, is not an authorised medicine for the Irish market, but as it is authorised in other markets, it can be supplied in Ireland in response to a prescriber's request to meet the needs of patients in their care. This is known as exempt medicinal product (EMP) supply. It should be noted that the HPRA has no role in assessing the quality, safety, or efficacy of EMPs. These medicines will have undergone an evaluation of their safety, quality and efficacy for the granting of their marketing authorisation in another EU Member State or third county by the respective competent authority for medicines. 

The availability of EMPs can depend on the products' availability in the source market. As a result, supply can be variable, and the HPRA does not have the same oversight over the supply of these types of medicines compared to medicines authorised for the Irish market.

However, the HPRA has identified the wholesalers that had supplied Petinimid to the Irish market and engaged with them when they received the initial query from the patient's carer. Information received from one main EMP wholesaler has indicated that there is a product delivery estimated to arrive on 8th June 2022 and will be available to pharmacies to dispense thereafter.

Covid-19 Pandemic

The pandemic recognition payment is being rolled out to eligible HSE and Section 38 staff currently. Some cohorts have received the payment, and every effort is being made by local sites to process the remainder through their payroll systems. 

Separately, my Department is preparing information for those other certain healthcare employees that are covered by the Government Decision, and the process available to their employers to implement this measure for their eligible staff. I am keen for this work to conclude shortly so that rollout and payments can begin. This shall cover eligible staff in:

- Private Sector Nursing Homes and Hospices (e.g. Private, Voluntary, Section 39 etc.);

- Eligible staff working on-site in Section 39 long-term residential care facilities for people with disabilities;

- Agency roles working in the HSE;

- Health Care Support Assistants (also known as home help / home care / home support) contracted to the HSE;

- Redeployed members of Department of Defence to work in the HSE;

- Paramedics employed by the Department of Local Government, Housing and Heritage

The Department of Public Expenditure and Reform introduced COVID-19 Special Leave with Pay for all public sector employees at the start of the pandemic, as a temporary measure to assist in preventing the spread of the virus in the work premises.

I am aware that long COVID is an issue for a number of public health sector staff, who remain absent on Special Leave with Pay in respect of long COVID. 

Officials in this Department and the Department of Public Expenditure and Reform will engage on this issue in advance of further changes being introduced in respect of COVID-19 Special Leave with Pay.

In respect of occupational supports available to support staff of the public health service who remain absent with long COVID, I have asked the HSE to respond directly to the Deputy.
