Ethics in Public Office

423. Deputy Róisín Shortall asked the Minister for Public Expenditure and Reform if he will publish the report into the findings of the ethics legislation review; the timeline that he is working towards in bringing forward new legislation in this area; and if he will make a statement on the matter. I am happy to inform the Deputy that the Review to which her question refers has been completed and a report was submitted to Government by my predecessor Minister McGrath in December. The Government approved the publication of the Review Report and agreed to the preparation of a General Legislative Scheme informed by the Review's outcome. The draft legislative scheme will be prepared in consultation with relevant Ministers and brought to Government for approval to publish during 2023. The Review Report itself is currently being prepared for publication and it will issue shortly.

As the Deputy may recall, my Department’s review of Ireland's statutory framework for standards in public office, which was agreed by the Government in September 2021, covered the following elements:

- A review of Ireland’s existing ethics legislative framework, including a reassessment of the 2015 Public Sector Standards Bill;

- A review of the recommendations of relevant tribunals of inquiry;

- A review of recommendations of the Standards in Public Office Commission (SIPO) based on its operation of the current regime;

- Consultations with the Department of Housing, Planning and Local Government on the local government aspects of a consolidated statutory regime.

- A review of current EU/International best practice; and

- Public Consultation.

The Review considered input from key public sector stakeholders including the Departments of Justice and Housing and Local Government. It also engaged with the Dáil and Seanad Committees on Members Interests. It also considered recommendations from the Standards in Public Office Commission.

I can inform the Deputy that the recommendations in the Review Report broadly focus on five key themes:

- A legislative framework for Ethics to be underpinned by a set of overarching integrity principles

- New specific statutory prohibitions, including on the use of insider information

- Strengthening disclosures requirements to improve transparency and examining whether the regime should encompass more office holders

- Strengthening the Standards in Public Office Commission (SIPO)

- Post-term employment restrictions for elected officials/public servants that address matters not already covered by lobbying regulation and should align closely with that legislation.

The Government’s ultimate goal is to create a fit-for-purpose, easy to understand and user-friendly ethical framework that contributes to the quality and efficacy of our public administration.

National Lottery

Durkan asked the Minister for Public Expenditure and Reform the extent to which the highest possible prizes have been won by players of the national lottery in the past twelve months; the way that this corresponds with the number of times that major prizes were won in the previous year; the extent of the cost of advertising in the past twelve months and in the previous year; if the community receives 90% of the proceeds of the National Lottery as advertised on television; and if he will make a statement on the matter. The National Lottery is a significant asset which plays an important role in generating funds for Good Causes throughout Ireland and across a range of areas including sport and recreation, culture and heritage, community health, the arts, and youth affairs.

The National Lottery Fund transferred €289m to the Exchequer in 2021 which represents a significant 14% increase on 2020 and is a record, unprecedented figure under the license commenced by Premier Lotteries Ireland (PLI) in 2014.

Circa €6 billion has been raised for Good Causes since the National Lottery commenced operations in 1987.

The number of times that the jackpot / top prize has been won in National Lottery draws in 2022 and 2021 is as set out in the table below.

The spend on advertising by PLI the operator of the National Lottery, for the last 12 months, is not currently available as the operator’s 2022 audited financial statements are not yet available.

The amounts allocated to the community (as defined in the operator’s advertisements, they include prizes, plus amounts to retailers’ commission, plus amounts to good causes) are about 90%.

425. Deputy Jim O'Callaghan asked the Minister for Public Expenditure and Reform when pensioners of Eircom will be entitled to the 3% increase in pension that was announced in July 2022; and if he will make a statement on the matter. [2313/23]

Generally, issues such as pension increases are matters for consideration of the sectoral Minister in the first instance and take into account the application of scheme rules as well as the overall sustainability of pension funds.

Section 10 of the Eircom scheme rules specifies that discretionary pension increases may be authorised by the Minister for Environment, Climate and Communications, with the concurrence of the Minister for Finance on foot of the recommendation of the Minister for Public Expenditure and Reform. 

My Department received a request for a pension increase for members of the Eircom pension scheme via the Department of Environment, Climate and Communications (DECC) on the 10th November 2022.

DECC and DPER have been engaging with the New Economy and Recovery Authority (NewERA) in recent weeks in relation to the increase requested. NewERA has been asked to prepare a report analysing the proposed increase and this is expected to be finalised shortly. 

When NewERA’s analysis of the proposed increase has been provided, my officials and I will give full consideration to the requested pension increase. Following the granting of Ministerial consent for a pension increase the timing of the payment of the increase will be a matter for the employing body.

The Office of Public Works (OPW) is responsible for the maintenance of the Maine Arterial Drainage Scheme under the Arterial Drainage Acts of 1945 and 1995, as amended.

The matter concerns an old derelict sluice gate that has not been operational for a number of years. It is not possible to keep the sluice gate open, as it continues to block up due to the level of mud at the location. Engineering staff have examined the issue and the sluice gate is not critical, as other sluice gates operate from the same back-drain. Engineering staff from the OPW are satisfied with the conveyance of the channel. I am advised officials from the south west region of the OPW have liaised with the person concerned.

As we navigate the most challenging and sensitive phase of the Decade of Centenaries 2012-2023, the Government's approach to commemorations continues to be under-pinned by the guidance of the Expert Advisory Group on Centenary Commemorations (EAG) and informed by consultation with the All-Party Consultation Group on Commemorations. The EAG has published three statements to date, which can be found on gov.ie.

(www.gov.ie/en/publication/a5ead-decade-of-centenaries/). I would urge everyone who has an interest in the current period of commemorations to consult the principles and advice set out in these publications

I am committed to ensuring that the State's approach to the remembrance of the Civil War and all of those who lost their lives during those years, is based on the respectful, sensitive, measured and authentic ethos that has become the hallmark of the Decade of Centenaries Programme. Historical accuracy, academic integrity and archival discovery are key tenets as the Civil War commemorative programme continues to develop, to follow the centenary timeline of the historical events of the period. It is important that our history is faithfully presented, even when the historical record is distressing. We must acknowledge the great tragedy of all of the lives that were lost or irrevocably altered during those divisive and traumatic years. I welcome and encourage the continuing research of historians and custodians of records, who seek to increase our understanding of the historical events that occurred, which have so significantly shaped our modern world. The State’s Decade of Centenaries Programme invites everyone to consider the painful legacies of our past and reach their own conclusions – the programme does not seek to communicate a preferred narrative or make judgements about any persons or actions. It is not appropriate for the State to retrospectively analyse historical events, through the lens of contemporary perspectives. This is best left to scholars trained in the discipline of history. The guidance of the Expert Advisory Group in this regard is clear – “The State’s task is to encourage a reflective and a reconciliatory tone that recognises that neither side had the monopoly of either atrocity or virtue and this was true of words as well as actions."

Cuireann Comhar Naíonraí na Gaeltachta (CNNG) tacaíocht ar fáil do ghrúpaí/coistí áitiúla le seirbhísí luathbhlianta a bhunú agus a reáchtáil sa Ghaeltacht.

Bhunaigh Údarás na Gaeltachta an cuideachta, Comhar Naíonraí na Gaeltachta Teo. (CNNG) in 2004 chun bainistiú agus riar a dhéanamh ar bhonneagar luathoideachais na naíonraí agus na seirbhísí cúram leanaí atá lonnaithe sa Ghaeltacht. Is ar an gCeathrú Rua atá an eagraíocht lonnaithe, le fo-oifigí i Maigh Eo, i nDún na nGall agus i bPort Láirge. 

Is iad príomh aidhmeanna na heagraíochta ná:

Sports Funding

In relation to my Department's responsibilities, the Sports Capital and Equipment Programme (SCEP) is the primary vehicle for Government support for the development of sports and physical recreation facilities and the purchase of non-personal sports equipment throughout the country. Grants are available for a wide variety of capital works and non-personal sports equipment including first aid kits and defibrillators.

In relation to future rounds of the SCEP, following completion of the appeal process last year, my Department commenced a full review of all aspects of the 2020 round of the SCEP. A draft of the Review has now been complete and I expect to be in a position to publish it shortly. Any recommendations arising from the Review will be reflected in the next round. Furthermore, my officials are engaging with the Department of Public Expenditure and Reform in relation to the next round of the SCEP. Once these discussions are concluded, I will announce the exact dates from which new applications will be accepted.

Defibrillators situated at sports clubs are generally also for community use and I am aware that funding is also available through the HSE’s national lottery grants schemes and other community grants schemes. At a local level, the network of local sports partnerships throughout the country delivers education and training opportunities across a broad range of areas to local sports clubs and community groups. This includes first aid workshops, which typically cover CPR and-or defibrillator training as part of the content.

A number of national governing bodies of sport also have schemes in place to support their club networks in cardiac care, screening and defibrillator training. The GAA’s community heart programme, the FAI’s heart care programme and the IRFU’s safe rugby programme are excellent examples of proactive supports to assist clubs and members to participate safely in sport.

The Sports Capital and Equipment Programme (SCEP) is the primary vehicle for Government support for the development of sports and recreation facilities and the purchase of non-personal sports equipment throughout the country. Over 13,000 projects have now benefited from sports capital funding since 1998, bringing the total allocations in that time to over €1.15 billion. The Programme for Government commits to continuing the SCEP and to prioritising investment in disadvantaged areas.

The 2020 round of the SCEP closed for applications on Monday 1 March 2021 and by the deadline a record 3,106 applications were submitted. Following the conclusion of the appeals process, the final set of allocations were announced at the end of May last year. The total allocation of €166.6 million for the 2020 round represented the highest level of allocation ever made under the SCEP.

The installation of LED floodlighting is funded under the SCEP and is specifically referenced in the "Guide to Making an Application". Numerous organisations have benefitted from SCEP funding for such floodlights and details of all allocations can be found at www.gov.ie/en/collection/471ed5-sports-capital-allocations/.

In relation to future SCEP applications, following completion of the appeal process, my Department commenced a full review of all aspects of the 2020 round of the SCEP. A draft of the Review has now been complete and I expect to be in a position to publish it shortly. Any recommendations arising from the Review will be reflected in the next round. Furthermore, my officials are engaging with the Department of Public Expenditure and Reform in relation to the next round of the SCEP. Once this process is concluded, I will announce the exact dates from which new applications will be accepted.

I understand that energy-efficiency promoting grants are also available to sporting clubs and facilities via the Sustainable Energy Authority of Ireland (SEAI). Further details can be found on its website at www.seai.ie.

The priority in the short term is to advance the successful applications, which number almost 2,900, under the 2020 round to "formal approval" and grant drawdown stage. This requires detailed, ongoing engagement with all grantees.

On 7 December 2022 the Government approved the priority drafting of the Registration of Short-Term Tourist Letting Bill and publication of the General Scheme of the Bill which provides for the registration of short-term tourist lettings with Fáilte Ireland in line with the commitment under Housing for All, the Government's housing policy.

I have written to the Chair of the Joint Oireachtas Committee on Tourism, Culture, Arts, Sport and Media regarding the Bill in line with agreed protocols for pre-legislative scrutiny. My Department is also engaging with the European Commission on the draft legislation under the notification requirements of the Technical Regulations Information System (TRIS) Directive. I look forward to engaging with Oireachtas colleagues with a view to passing the legislation in the coming months.

With regard to resourcing, I understand that Fáilte Ireland has appointed a dedicated team of ten staff to establish, maintain and implement the proposed short-term tourist letting register. This team is assisted by other teams across Fáilte Ireland including legal, ICT and finance functions.

Preparations are being made for the launch of the register, including the establishment of the necessary systems and procedures to maintain and implement the register, the development of a registration portal, and various stakeholder engagements.
