The Office of Public Works (OPW) is responsible for the maintenance of arterial drainage schemes and flood relief schemes completed under the Arterial Drainage Acts, 1945 and 1995, as amended. The location concerned does not form part of any Arterial Drainage Scheme which would fall under the remit of the OPW.
I am informed by Inland Fisheries Ireland (IFI) who operate under the aegis of the Department of the Environment, Climate and Communications (DECC) and who are leading in relation to this matter, that they have previously submitted a planning application to Tipperary County Council for works in the location referenced and that planning permission has not yet been granted.
