My Department has no direct function in relation to the provision of disability services to individuals. The Department is responsible for the formulation and development of policy in respect of the provision of specialist disability services; responsibility for the management and delivery of those services rests with the Health Service Executive (HSE).

In this regard, I have arranged for the question to be referred to the HSE for direct reply to the Deputy.

Rights of People with Disabilities

Deputy Ged Nash asked the Minister for Children, Equality, Disability, Integration and Youth if he will confirm that when making provision for the European Accessibility Act (EU Directive 2019/882), he will ensure that every ATM and point-of-sale credit card terminal is accessible to people who are blind and visually impaired, and that this will include provision for audio guides and tactile keyboards; and if he will make a statement on the matter. I intend to fully transpose the European Accessibility Act in the manner required by the Directive.

Accessibility is a key facilitator for the meaningful inclusion and participation of people with disabilities in our society, including people who are blind or visually impaired.

The European Accessibility Act is an important EU Directive that will introduce mandatory minimum accessibility requirements for certain products and services across the European Union. These requirements will apply to both the public and private sectors.

The Directive covers a range of commonly used products and services including payment terminals and certain self-service terminals such as ATMs. It advocates for a universal design or ‘design for all’ approach to accessibility, which means ensuring access for persons with disabilities on an equal basis with others.

Under the terms of the Directive, products such as payment terminals and ATMs must be designed and produced in a way to maximize their use by people with disabilities.

This means that products must contain features and functions that allow people with disabilities to access, perceive, operate, understand and control the product. This includes providing access via more than one sensory channel and alternatives to vision, auditory, speech and tactile elements. Products will also have to be compatible with assistive devices.

In addition to product design and functionality, products will have to be accompanied by accessible information on their functioning and on their accessibility features.

The annexes of the Directive set out the technical accessibility requirements for relevant products and provide indicative examples to facilitate compliance, including measures designed to support blind or visually impaired people.

Ireland recognises the importance of the European Accessibility Act for advancing the rights of people with accessibility needs, including people who are blind or visually impaired. Extensive work is underway to transpose the accessibility requirements set out in the European Accessibility Act in the earliest possible course. Implementation of the Directive is required by 28 June 2025.

Equality Issues

Deputy Mary Lou McDonald asked the Minister for Children, Equality, Disability, Integration and Youth if he will outline the progress to date on the development of a legal ban on the practice of conversion therapy; when he expects legislation to be ready for introduction; and if he will make a statement on the matter. The Programme for Government contains a commitment to legislate to ban conversion therapy. The National LGBTI Youth Strategy 2018 – 2020 and the National LGBTI+ Inclusion Strategy 2019 – 2021 contain commitments in relation to conversion therapy. The LGBTI+ National Youth Strategy provides for the prohibition of “the promotion or practice of conversion therapy by health professionals in Ireland” and the National LGBTI+ Inclusion Strategy commits to investigating conversion therapy in Ireland and following up with appropriate counter measures.

The Department of Children, Equality, Disability, Integration and Youth commissioned research into the issue of conversion therapy. The multi-phased mixed-methodology research was carried out by Trinity College Dublin, School of Nursing and Midwifery, and a report of the findings was published in February 2023. The research provides an insight into how conversion therapy practices operate in Ireland. It also includes an examination of the growing body of recent international research literature in the area. The findings of the research indicate that conversion therapy practices take place in Ireland, and has developed understanding of how these practices operate. It confirms the harm that is inflicted on those who experience such practices.

Given the potential complex and sensitive nature of the proposed legislation, the Government is carefully considering the underpinning policy matters to ensure that vulnerable members of society are protected from these harmful practices. Work on the plan to draft legislation is ongoing including the identification of the key legal issues, and is a priority for Government this year. It is planned that legislative proposals will be brought forward by the end of the year, informed by this research and international best practice.

Deputy Paul Murphy asked the Minister for Health if he is aware that those currently completing a doctorate in counselling psychology at Trinity College, Dublin will now be the only trainee psychologists without any funding; if he will assure that this issue is rectified; and if he will make a statement on the matter. As the Deputy is aware, €750,000 has been provided in Budget 2023 to support counselling psychology training places. This funding demonstrates the Government’s commitment to strengthen access to psychology training.

I am focussed on supporting counselling psychology students in an equitable way and that delivers value for money. The structure of this funding is currently being finalised by officials in the Department. The approach will be based on best practice and knowledge gained from other health and social care funded training models.

Further detailed discussions are now taking place between the Department and HSE to progress this. I hope to be in a position to announce the details shortly for academic year 2023-2024.
