136. Deputy Bernard J. Durkan asked the Minister for Social Protection the reason an income derived from contributions made by a PAYE employee to an approved retirement scheme is now deemed to be in self-employment when applying for jobseeker’s transition payment in the case of a person (details supplied); and if she will make a statement on the matter. The Person Concerned applied for Benefit Payment for 65-Year-Olds(BP65) on the 24/05/2022. This application was refused on the basis that the qualifying conditions attached to the scheme were not satisfied.

The Person Concerned appealed the decision on 3/6/22, stating that they had not been employed or self-employed since December 2017. The Appeals Officer concluded that the Person Concerned continues to be a self-employed contributor in respect of their Approved Retirement Fund income and therefore has not established that they meet the requirements as set out in the legislation and so the Appeal was disallowed.
