I am unable to comment on individual cases, but I am aware of this very sad tragedy, and I would like to express my sincere sympathy to the family. I have asked the HSE to respond directly to the Deputy in a timely manner on implementation of relevant recommendations.

Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.

In relation to the particular query raised, as this is a service matter, I have asked the Health Service Executive to respond to the Deputy directly, as soon as possible.

Dear Deputy Nolan,

I refer to your Parliamentary Question of Thursday 6 July 2023 (Reference: 34150/23).

‘To ask the Minister for Health if his Department or any agency under the aegis of his Department operates a ‘barter account’ for the provision of goods or services; if so, if payments have been directed to be made to a barter account during the period 2011 to date; and if he will make a statement on the matter. .’

The response to this query will require the collection of information from suppliers who previous worked for the Department of Health back to 2011. It will also require collection of information from the 19 other agencies falling under the aegis of the Department of Health and their related suppliers going back to 2011. My officials will collate this information and share with the Deputy as soon as is possible.

In December 2022, Children’s Health Ireland (CHI) announced it had commissioned an external clinical review of complex spinal surgeries carried out in Temple Street on a specific group of children with spina bifida during a period between October 2019 and October 2022.

The review involves expert clinicians from an international North American centre of excellence.

Once this external review has been finalised, its findings will be communicated appropriately, particularly with regard to any patients and families impacted.
