56. Deputy Paul Murphy asked the Tánaiste and Minister for Defence if he will ensure broader terms of reference for an inquiry to investigate whether there have been serious systemic failures in the complaints system in the Defence Forces in respect of interpersonal issues, including, but not limited to, sexual misconduct; and if he will make a statement on the matter. The Government agreed to progress, as a priority, the recommendations in the Report of the Independent Review Group (IRG). This included the establishment of Statutory Inquiry to examine the effectiveness of the complaints processes in the Defence Forces and to address workplace issues relating to discrimination, bullying, harassment, sexual harassment and sexual misconduct.

I have consulted with a range of stakeholders in relation to the appropriate type of Inquiry and in the preparation of the terms of reference. Having carefully considered their views, I believe that an open, independent and transparent appraisal of the issues raised by the IRG is the best way to examine the issues raised. The Government have now approved that the Inquiry should be by way of a Tribunal of Inquiry.

The preparation of the terms of reference is continuing. I am considering correspondence received from stakeholders in relation to the terms of reference for the inquiry. I will revert to Government in the Autumn, seeking approval for terms of reference and the appointment of a Judge to Chair the Tribunal.
