176. Deputy Paul Murphy asked the Minister for Enterprise, Trade and Employment if he will confirm whether a disclosure to Minister Fitzgerald in July 2017 (details supplied) was included in the Department’s Protected Disclosures Report for 2017, as required under Section 22 of the Protected Disclosures Act; and, if so, what specific wording was used to declare that disclosure. The Deputy will be aware that each public body is required under Section 22 of the Protected Disclosures Act 2014 to publish an annual report setting out the number of protected disclosures received in the preceding year and the action taken (if any). This report must not result in persons making disclosures being identifiable.

The Departments Protected Disclosures Report for 2017 is attached and is available on the Department's website.

The matter referred to in the Deputies question is the subject of ongoing legal proceedings and therefore it would not be appropriate for me to comment further at this time.
