As this Parliamentary Question relates to an operational issue, it is a matter for the HSE. However, members of the Oireachtas are advised that the HSE is currently not in a position to answer PQs due to industrial action. It is hoped that normal services will resume soon. I wish to advise the Deputy that the HSE already has in place protocols governing the disposal of properties which are identified as surplus to health requirements.

The HSE Protocol for the Acquisition and Disposal of Property sets out the procedures to be followed when the HSE acquires or disposes of a property interest. This protocol fully reflects the requirements of DPENDR Circulars on the disposal of surplus property.

HSE’s Protocol for the Acquisition and Disposal of Property satisfies the obligations of Section 53 of the Land Development Agency Act 2021.

When the HSE identifies a health property and/or land surplus to health requirements, the HSE Protocol for the Acquisition and Disposal of Property sets out the following hierarchy for the disposal of HSE surplus properties:

1. Land Development Agency – The property is first offered to the LDA. If the LDA has no requirement for the property the next level is to offer the property via the State Property Register.

2. Intra-State Transfer – The property is offered via the State Property Register to other State entities and the Local Authority in the area. If there is no State stakeholder interest the property may be disposed on the open market.

3. Open Market – The property is offered to the open market in line with the Property Protocol - Public auction, Sealed bid tender, Open competition.

In addition to the above and sharing details of those properties surplus to health needs with the local authorities, the HSE has, on a number occasions in 2022 and 2023, provided a full list of properties surplus to health requirements to both the Department of Housing and the Department of Children, Equality, Disability, Integration and Youth. This list of properties was provided to the above Departments as part of the HSE's ongoing engagement with both Housing For All and the whole-of-government response to the provision of accommodation for Ukraine refugees.

As the Health Service Executive is responsible for the delivery of public healthcare infrastructure projects, I have asked the HSE to respond to you directly in relation to this matter.

As the Deputy may be aware, management and administrative grade staff in the Fórsa union in the HSE commenced industrial action on Friday 6th October. As a consequence of this industrial action, members in these grades are not engaging with political forums or processes. As a result, the question asked by the Deputy may be delayed in receiving a response directly from the HSE.

Firstly, I want to express my sincere gratitude to all healthcare workers for their continuous efforts during the Covid 19 Pandemic.

Last year the Government announced a once-off, ex-gratia COVID-19 pandemic recognition payment for certain frontline public sector healthcare workers, to recognise their unique role during the pandemic.

Eligibility criteria for the payment were set following a significant consideration and consultation process. I can confirm that in order to receive the recognition payment, staff must have:

• Been in COVID vaccination cohorts 1 or 2, and

• Worked ordinarily onsite in a COVID-19 exposed healthcare environment, and

• Worked for at least 4 weeks in the 1/3/2020 – 30/6/2021 period, and

• Worked in a HSE/Section 38 organisation, or one of the following:

1.Private Sector Nursing Homes and Hospices (e.g. Private, Voluntary, Section 39 etc.);

2.Section 39 long-term residential care facilities for people with disabilities, working on-site;

3.Agency roles working in the HSE;

4.Health Care Support Assistants (also known as home help / home care / home support) contracted to the HSE;

5.Members of the Defence Forces redeployed to work in frontline Covid-19 exposed environments in the HSE;

6.Paramedic staff employed by Dublin Fire Brigade to deliver services on behalf of the HSE.

Only those staff who met all the above eligibility criteria were covered for this payment. I appreciate that many other workers, volunteers, and other citizens provided very important services during the pandemic.

The Government appreciates that those organisations and staff who do not meet the eligibility criteria for this particular payment may feel disappointed. It was a hard task to set out the eligibility for this payment but the Government based its decision on the risks which eligible frontline workers faced. Undoubtedly immense efforts have been made by all healthcare staff since the onset of the pandemic which has not gone unrecognised.

Food safety policy is a priority for my Department, and this is informed by scientific advice from the Food Safety Authority of Ireland(FSAI) and the European Food Safety Authority (EFSA).

I am advised by FSAI that newly developed synthetic foods are classified as novel foods. Novel foods are foods which have not been consumed to a significant extent in the EU before May 1997. Regulation (EU) 2015/2283 of the European Parliament and of the Council of 25 November 2015 on novel foods, provides for the assessment and authorisation of such foods before they can be placed on the EU market. The Regulations also set out the manner in which the novel foods can be placed on the market once approved.

Synthetic foods such as cultured meat, lab meat and cultivated meat, are not currently authorised as novel foods in the EU. Due to the use of new technologies and production processes, these types of products will require pre-market authorisation as novel foods under Regulation (EU) 2015/2283. The FSAI informs me that there have been no applications for cultured meat, lab meat and cultivated meat to be authorised as a novel food in the EU to date.

When a novel food application is submitted it is fully assessed by EFSA. A stringent scientific evaluation of the applicant food product is carried out by EFSA before an opinion on the safety of the food is issued. If a favourable opinion is issued, it then falls to Member States to vote on a legislative proposal on novel food authorisations. As the competent authority the FSAI will advise my Department on any such applications.

There is no process being considered to reclassify Section 39 with those on a S38 contract and therefore no costings are available.

It is worth noting that Section 39 are not public bodies, and the terms and conditions of employment for staff in these organisations are ultimately between the employer and the employee. Although we are not the employers, the Department is aware that staff employed across the hundreds of funded organisations have been employed using a multiplicity of terms and conditions, including different rates of remuneration and are dependent on Government for funding
