Deputy Mairéad Farrell asked the Minister for Justice if she is aware of the recommendations contained in the report the 'human and financial cost of clinical negligence claims: the case for pre-action protocols’; the plans, if any, she has for tort reforms in the area of dental practice; and if she will make a statement on the matter. View answerI can inform the Deputy that I have received a copy of a report entitled “The human and financial cost of clinical negligence claims: The case for pre-action protocols" (January 2024), and I have asked my Department to examine it.
My Department is developing draft pre-action protocol regulations the purpose of which will be to encourage early resolution of clinical negligence actions and it is intended to publish these in 2024.
