Vol. 14 No. 12

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - CUSTOMS DEPARTMENT SEIZURE.

asked the Minister for Finance whether he is aware that a registered letter packet containing one lady's gold watch addressed to Miss Julia Flanagan, Pluckerstown, Kilmeague, County Kildare, by a friend in the United States, America, has been retained as a seizure by the Customs Department, 10 Parnell Square, Dublin, under Section 207 of the Customs Consolidation Act, 1876; that Miss Flanagan, in reply of the 16th February, 1926, to the Department's letter of the 15th February, 1926, gave permission for the opening of the packet, stating that she was willing to pay duty on receipt of packet at Kilmeague Post Office; that the Department on the 18th February, 1926, wrote, stating that the packet would be retained as a seizure; and whether, in view of the fact that there was no intention to defraud and also of the illegible figure entered on the Department's letter of the 15th February, stating the number of days' notice, he will authorise the delivery of the watch, on payment of duty by Miss Flanagan.

The watch in question, being liable to duty and being imported by letter post, was liable to forfeiture, and was accordingly detained by the Customs Officer at the Foreign Parcel Post Depot, Dublin. On the assumption that there was no fraudulent intent in the transaction, the Revenue Commissioners are prepared to waive forfeiture and fine, and have ordered that delivery may be allowed on payment of duty.
