CEISTEANNA—QUESTIONS. ORAL ANSWERS. - DISPOSAL OF COURT AWARD.

asked the Minister for Finance if he is aware that a decree for £40 and £4 3s. 0d. costs for compensation for criminal injury to property by British Forces was made on the 3rd day of June, 1921, by Judge Doyle, then Recorder of Galway, in favour of Mr. William Hickey, merchant, Loughrea; that this decree was reviewed by the Compensation (Ireland) Commission without notice of such review being given to Mr. Hickey; that the findings of the Commission was an award of £2 with £4 3s. 0d. costs, and if he will state whether this £6 3s. 0d.—award and costs—was handed over to the Revenue Commissioners, and not to Mr. Hickey.

An award of £2 with interest at 5 per cent. from the 1st July, 1923, and £4 3s. 0d. costs and expenses was made by the Compensation (Ireland) Commission in favour of William Hickey, Loughrea, Co. Galway, on review of an undefended decree for £40, with £4 3s. 0d. costs and expenses, made by the Recorder of Galway on the 3rd June, 1921. The Minister for Finance is not aware that the case was reviewed by the Commission without notice to Mr. Hickey.

In connection with the Commission's award, a total sum of £6 3s. 10d. was, on the 5th December, 1923, paid to the Revenue Commissioners in part discharge of Income Tax arrears outstanding, Mr. Hickey's solicitor having been notified by the Department of Finance on the 22nd November, 1923, that this course would be adopted if the arrears were not paid in the meantime.
