asked the Minister for Justice if he is aware that goods seized by the Gárda Síochána from Mrs. Mary McCarthy, of 8 Dorset Avenue, Dublin, who was arrested for trading in Dorset Street on the 19th February, have not been returned; and if he will state the reason for this action, in view of the fact that Mrs. McCarthy was fined on the occasion.

When Mrs. McCarthy was arrested for offences against the Street Trading Act, 1926, it was necessary for the Gárda Síochána to remove her goods, which were of a perishable nature. Under the Act Mrs. McCarthy might, if she so desired, secure the return of the goods by paying the cost of the removal, 3/-, but she refused. In the circumstances the Commissioner had no option but to exercise his powers under Section 11 of the Act and order that the goods be sold. The amount realised was 3/-, which was credited in aid of the Gárda Vote. It is not possible to make any refund to Mrs. McCarthy.
