Vol. 38 No. 7

Ceisteanna—Questions. Oral Answers. - Resumption of Co. Galway Holding.

asked the Minister for Lands and Fisheries whether he will state by what authority the Land Commission refuse to furnish James Dwyer, of Lowertown, Woodford, Co. Galway, with a copy of the resumption notice served on William J. Farren regarding the holding from which Dwyer's mother was evicted, being holding No. 57, J. A. Lewis Estate, Co. Galway; also a copy of Mr. Farren's objection to same, and a copy of the evidence tendered by Mr. Farren in support of his objection.

I have to refer the Deputy to my replies to his previous questions of 4th June, 1930, and 30th April, 1930, on this matter. In reply to his request for copies of documents relative to the resumption proceedings for the holding of Mr. W. J. Farren, No. 57 on the J. A. Lewis Estate, Co. Galway, Mr. Dwyer was informed that he would be furnished with a copy of the Order made on the objection before the Land Commission in the matter, and a copy of the Order made by the Judicial Commissioner therein, but he did not lodge the necessary stamped requisitions for these. It is not the practice of the Land Commission to furnish copies of objections in such cases or of the evidence in support thereof—following the usual practice in court proceedings that only the parties thereto are entitled to copies of pleadings.
