Ceisteanna—Questions. Oral Answers. - Carden Estate (Co. Tipperary).

asked the Minister for Lands and Fisheries whether the Judicial Commissioner decided in favour of a 10 per cent. reduction to the tenants on the Carden Estate, Templemore, Co. Tipperary, in the Land Court; whether that decision was given effect to by the Land Commission when the lands were being vested, and, if not, if he will state the reasons why.

The Standard Purchase Annuities in respect of the tenancies on the Carden Estate were fixed in accordance with the provisions of the Land Acts 1923-1931 on the basis of the rents returned by the owner of the Estate.

The abated rents referred to by the Deputy were determined by the Judicial Commissioner as the basis for the calculation of payment in lieu of rent and compounded arrears of rent only.

Is the Parliamentary Secretary aware that the Judicial Commissioner gave a decision in favour of the tenant with 10 per cent. reduction?

They are adding that 10 per cent. to the old judicial rent. Will the Parliamentary Secretary state what is the reason why the decision of the Judicial Commissioner is not followed?

The Judicial Commissioner's decision applies only to the payments in lieu of rent and compounded arrears of rent.

Did not the Judicial Commissioner decide in favour of 10 per cent. reduction?
