Vol. 43 No. 6

Ceisteanna—Questions. Oral Answers. - Allotment of Lands.

asked the Minister for Lands and Fisheries whether the lands at Kilmorna, County Kerry, in the De Janasz Estate are vested in all the present occupiers, and if so, if there is a clause in their agreements to the effect that they cannot dispose of those lands until after the expiration of a certain number of years.

The allotments made on the division of the untenanted lands on the De Janasz Estate at Kilmorna, County Kerry, have not yet been vested in the allottees. In accordance with the usual practice of the Land Commission the purchase agreements signed by allottees prohibit them from disposing of their interest in their parcels before the lands are vested in them, without the consent of the Land Commission. This reservation is specially necessary in cases where the parcel is given for enlargement of an existing holding, so that the parcel may not be sold and the intention of the Land Commission defeated. The majority of the allotments on this estate were for this purpose.
