Vol. 46 No. 6

Written Answers. - County Kerry Estate.

Mr. Daly

asked the Minister for Lands and Fisheries if he is aware that the sub-tenants in the Stroughton Estate near Caherciveen, County Kerry, have been threatened with legal proceedings by the tenant, Mr. Maurice Fitzgerald, if the rents on their holdings, which fell due last November, be not paid immediately; and whether the Minister will take the steps necessary to ensure that such sub-tenants will receive the benefit of pending legislation, in common with ordinary tenants, in respect of land annuities and arrears of land annuities.

Communications have been received from some of the sub-tenants on the holding of Maurice Fitzgerald on the estate of W.A. Stroughton, County Kerry; stating that their immediate landlord has instituted legal proceedings for the recovery of arrears of rent.

The question of declaring the sub-tenants in question direct tenants in accordance with the provisions of Section 15 of the Land Act, 1931, is being dealt with as expeditiously as possible. In the event of the sub-tenants being declared direct tenants they will be treated as ordinary tenants, and will receive the benefit of any legislative enactment then in force.
