Vol. 69 No. 19

Ceisteanna—Questions. Oral Answers. - Scottish Charge against Irish National.

asked the Minister for Justice whether it has been brought to his notice that, arising out of a decision of the Supreme Court, an Irish national was removed in custody without trial from the jurisdiction of the Irish courts on a warrant issued outside this country to answer a charge preferred against him in Scotland and framed according to Scottish law; whether it is a fact that the person concerned was never domiciled in Scotland and resided in Dublin all his life, and if he will introduce proposals for legislation to amend the criminal code to ensure that an Irish national who was never within the jurisdiction of a foreign court and never committed an offence within the jurisdiction of that court shall not be removed without trial from this country to answer a charge in respect of a criminal offence in a foreign court.

The case to which the Deputy refers has been brought to my notice. The question of the enforcement in this State of warrants issued in other States is at present under consideration, and it is hoped to introduce legislation on the subject at an early date.
