asked the Minister for Lands if he will state the total amount of land bonds due for purchase of the estate of Mrs. Geraldine Foley-Turpin, Youngrove, Midleton, County Cork, Record No. S.3991, and also when he is prepared to pay over this amount to the vendor in view of the fact that these lands were finally vested as far back as 1934, having been previously entered since 1924, and further as no interest has been paid on these land bonds to the vendor since 1931, if he is prepared to order the immediate release of £300 of this sum due, to be paid to the Cork County Council for accumulated rates due on these lands in consequence of the delay in payment of these sums to the vendor.

The statement of ownership filed in the estate of Mrs. Sarah Geraldine Foley-Turpin and Mrs. Constance Ritter, Record No. S.3991 County Cork, comprises both tenanted and untenanted land. The tenanted land became vested in the Land Commission on 1st November, 1931, the appointed day, under Section 9 of the Land Act, 1931. The untenanted land has not become vested in the Land Commission, nor has a price been fixed therefor. The purchase price of the tenanted land is £1,066, payable in 4½ per cent. land bonds. Title to the purchase price was lodged on 3rd February, 1936, and rulings on the title were issued by the Examiner of Title to the solicitors for the owners on 8th April, 1936. The rulings on title have now been discharged and the draft allocation schedule has been settled by the Examiner. It remains for the solicitors for the owners to bring in the allocation schedule and have the dates fixed for vouching by the Examiner and allocation before the Judicial Commissioner. Allocation of the purchase price is exclusively a matter for the Judicial Commissioner. Interest on land bonds representing the purchase price of an estate sold under the Land Acts, 1923 to 1936. will not ordinarily be paid out before the allocation of the purchase money unless application be made as provided by Section 36 of the Land Act, 1931, and Order XI of the Provisional Rules. No application for payment of interest on the land bonds pending allocation has been made in this matter.
