Ceisteanna—Questions. Oral Answers. - Acquisition of Lands.

asked the Minister for Lands if he will state whether the Land Commission have instituted proceedings for the acquisition of the lands of Miss Julia Morris, Stonebrook, Ballymore-Eustace, comprising over 200 acres, and, if so, how the matter now stands.

The Land Commission have not instituted proceedings for the acquisition of the lands of Coghlanstown West and Ballymore-Eustace West and Longstone, held by Miss Morris, of Stonebrook, Ballymore-Eustace, and they do not propose to take any action regarding the acquisition of these lands.

Is the Minister satisfied that the owner of these lands complied with the Compulsory Tillage Order last year?

That is a separate question.

asked the Minister for Lands if he is aware that the Land Commission have acquired the estate of Matthew Fahey, deceased, at Islandeady, Westport, in the County of Mayo, for the purposes of relieving congestion; if he will state the date on which the said lands were acquired, and the date upon which a scheme for their distribution was approved by the Land Commission; if this latter scheme provided for the erection of certain dwelling houses, and if he will state the reasons for the non-erection of the said dwelling houses and the reason for the non-distribution of the said estate by the Irish Land Commission in accordance with said scheme.

Possession of the estate of Matthew Fahey, deceased, was taken by the Land Commission on 16th May, 1938, the allotment scheme having been already approved. The scheme includes provision for the erection of dwelling houses on five new holdings provided for migrants.

In May, 1938, and the following months, four parcels and one new holding were allotted, leaving one parcel and four new holdings on hands for allotment. A right of way over the portion of the estate not acquired by the Land Commission is required for access to the lands on hands, and prolonged negotiations for the granting of this right of way have been carried on with the representatives of the former owner without result. Proceedings have now been instituted to acquire the right of way compulsorily. Pending the completion of these proceedings, the lands cannot be allotted or the buildings erected.
