Ceisteanna—Questions. Oral Answers. - Verschoyle Estate Trust Fund.

asked the Minister for Lands if he will state the present position of the trust fund in connection with the Verschoyle Estate, Cloney, Athy, County Kildare; the names and addresses of the present trustees, the amount of accumulated interest in the fund and the date of the last expenditure from it in respect of the clearance of drains for which it was originally created; and whether, since the drains in question have since been included in the Barrow drainage district, the interest so accumulated should now be diverted to the payment to Kildare County Council of arrears of Barrow drainage rate in respect of the lands for which the trust fund was created.

The maintenance trust fund in the Verschoyle Estate, County Kildare, is at present represented in regard to capital by a sum of £1,052 12s. 6d. in 4 per cent. Conversion Loan. The accrued income to credit of the fund comprises £10 16s. 2d. in cash and sums invested respectively in Second National Loan, £17 0s. 1d.; Third National Loan, £211 4s. 10d.; Fourth National Loan, £303 16s. 2d.; and Conversion Loan, £58 12s. 8d.

The present trustees are: Messrs. George Cecil Gilmore of Cloney, Athy; Thomas Kelly of Kilbarry, Athy; and Patrick Heffernan of Cloney, Athy. The last payment made to the trustees from the income of the fund was £20 on the 29th May, 1940.

The fund, which was provided primarily for the maintenance of six drainage and embankment works on the estate, is administered under the provisions of a deed of trust dated 5th January, 1927. Of the six works mentioned in the deed, only two have been included in and will be maintained as part of the Barrow drainage scheme.

The Land Commission are advised that the accumulated interest of the fund cannot legally be diverted to payment of arrears of Barrow drainage rate.
