Ceisteanna.—Questions. Oral Answers. - Applications for Military Pensions.

asked the Minister for Defence if he will reconsider the application of Mr. James Drennan, Vicarstown, Stradbally, County Leix (34 SP/59700), for military service pension under the 1934 Act, as this man is a deserving applicant to whom the Act should apply.

The finding of the referee on the evidence before him on the application made by Mr. James Drennan, Vicarstown, Stradbally, Leix, under the Military Service Pensions Act, 1934, was that Mr. Drennan is not a person to whom the Act applies. When notified of this finding Mr. Drennan applied for its reconsideration. The Referee reconsidered the case but found no cause to vary his finding. In the circumstances, I do not propose to refer the case back to the referee for review.

asked the Minister for Defence if he will reconsider the application of Mr. Michael Whelan, Kilbride Street, Tullamore, County Offaly, for pension under the Military Service Pensions Act, 1934; if he is aware that this applicant was informed by his Department on 5th October, 1944, that he was not a person to whom the Act referred, and if he will now have evidence taken from Mr. Whelan and his superior officers of the I.R.A. so that the case may be favourably disposed of.

Mr. Michael Whelan, Kilbride Street, Tullamore, Offaly, was orally examined at the office of the referee on the 30th January, 1940, on his application under the Military Service Pensions Act, 1934. The finding of the referee on the evidence before him, including that tendered orally by Mr. Whelan, was that Mr. Whelan is not a person to whom the Act applies. When notified of this finding Mr. Whelan applied for its reconsideration, but the referee found no cause to vary his finding. Representations were made to me in August last to have the case reviewed. The evidence submitted was not, however, of a nature to warrant the reopening of the case and Mr. Whelan was informed accordingly on the 5th October last. In the circumstances, I am not in a position to take any further action in the matter.
