Ceisteanna—Questions. Oral Answers. - Kerry Road Workers and Superannuation.

Mr. Flynn

asked the Minister for Local Government whether he is aware that, owing to the operation of Section 38 of the Local Government (Superannuation) Act, 1948, a number of road workers in County Kerry who are over 60 years of age are precluded from any benefits under the Act; and, if so, whether he will take steps to introduce proposals for legislation to ensure that these workers will obtain the benefits allowed.

My attention has been drawn by various interests to a number of points arising out of the Local Government (Superannuation) Act, 1948. The Act, however, has only been a short time in operation and it would be premature to propose further legislation until more experience of its operation has been gained. As regards existing servants over 60 years of age, Section 88 of the Act applies Part IV of the Local Government Act, 1925, to such servants and so entitles those of them who have the necessary continuous service to obtain a pension.
