Ceisteanna—Questions. Oral Answers. - Tipperary Estates.

asked the Minister for Lands what steps, if any, have been taken by the Land Commission to acquire, for division, the O'Halloran estate at Lurgo, Killenaule, County Tipperary.

The Land Commission decided to take no action for the present for the acquisition of these lands.

asked the Minister for Lands if he will state when the Land Commission intends to divide the Griffen estate at Castlelake, Knockroe, Cashel, County Tipperary, and if the commission intend to consider favourably the application of smallholders who were granted farms on the Kennedy estate, Mantlehill, Golden, for extension of their holdings on the first-mentioned estate.

I regret I am unable to state the exact date on which the Land Commission will allot these lands. The answer to the second part of the question is: the Land Commission always consider the claims of all persons within a reasonable distance of lands which are to be divided.

asked the Minister for Lands if it is intended to acquire for division the lands of the late Captain Murray Moore at Barne, Clonmel, County Tipperary, comprising some 764 acres.

Preliminary inquiries are being made at the moment, but it is not possible to state what decision the Land Commission will come to.

asked the Minister for Lands if any steps have been taken by the Land Commission towards acquiring for division the Kennedy estate at Castleblake, Gosegreen, Fethard, now in the occupation of a Mr. John Rohan.

The Land Commission inspected this estate and decided to take no action for the present for the acquisition of these lands.

Will the Minister say if he is aware that, as long ago as 1941, the Irish Land Commission decided that this estate was one that should be acquired by them? Is he further aware that proceedings were instituted by the Land Commission, and that evidence, which is known to be untrue, was tendered, and that that evidence was responsible for a court decision being made against the Land Commission? Will the Minister now say if he will have inquiries made with regard to the immediate acquisition of this estate?

If, as the Deputy says, false evidence or untrue evidence was tendered which defeated the intention of the Land Commission to acquire this land, I shall certainly ask the commissioners to investigate the whole case as made by the Deputy. I would point out that in the case of lands inspected a long time ago—the Deputy says that in this case they were inspected in 1941—circumstances sometimes change from what they were at the time proceedings were instituted. At that time they may have come within the net of the Land Acts, but, circumstances sometimes change, whereby lands, if they are well worked put themselves outside the scope of the Land Commission. If any changes were to be introduced to meet the Deputy's wishes, that would be a matter for legislation.

asked the Minister for Lands if he is in a position to state what steps, if any, have been taken by the Land Commission towards acquiring the estate of the late Michael Ryan, Loughkent, New Inn, Cahir, County Tipperary.

The Land Commission have no proceedings for the acquisition of these lands.
