Ceisteanna—Questions. Oral Answers. - County Cork Compulsory Purchase Order.

asked the Minister for Local Government whether he has received for approval a compulsory purchase order recently made by the Cork Assistant County Manager; and, if so, whether he is in a position to state (a) what is the general position under this order; and (b) what is the position under the order as regards sites for non-municipal houses in the town of Castlemartyr.

An order for the compulsory acquisition of sites for labourers' cottages in the South Cork County Health District was received in the Department in April, 1948. In August, 1948, the acquisition of sites for 365 cottages was confirmed under a first confirmation Order. A public local inquiry in connection with the remaining sites was held in six different centres in October, 1948, and in March, 1949, the acquisition of sites for a further 416 cottages was confirmed under a second confirmation Order. Twenty-four sites involving 55 cottages were excluded from the Order. The last mentioned sites included one for the erection of 20 cottages at Castlemartyr as it was discovered that service of the statutory notice in regard to this site was defective. No other compulsory purchase order has been made recently in respect of this area but it is understood that a further order which will include provision for cottages in the Castlemartyr district is being prepared and will be submitted to the Department in due course.

Arising out of the Minister's reply, will the Minister state how the compulsory purchase order is defective? Am I right in stating that it was on a different man's land altogether?
