Vol. 168 No. 6

Ceisteanna—Questions. Oral Answers. - Cappoquin Land Project: Diversion of Water Supply.

asked the Minister for Agriculture whether he is aware that in the carrying out of a land project scheme Mr. Patrick Kiely, Ballyhane, Cappoquin, was deprived of his existing water supply; that the supply was diverted to a point from which it is almost impossible to secure supplies in wet weather; that Mr. Kiely's repeated requests to have the matter remedied have been refused; and that, notwithstanding the conditions of the scheme as entered into between Mr. Kiely and the Department, the lands have been left with open cuts; and if he will order an investigation with a view to having this matter settled.

I have fully considered this case and I am satisfied that Mr. Kiely has not any reasonable grounds for complaint.

Is the Minister aware that there are open cuts still left in the field in connection with the improvement carried out and would he consider it would be reasonable that these should be closed in?

As far as I can find out from my examination of the case, the open cut was one constructed at the owner's request. It was not originally provided for in the specification. What the Deputy says may be true, but I do not think it gives any cause for complaint as far as the landowner is concerned.
