asked the Minister for Justice if he is aware of the fact that a circular outlining a case against Proportional Representation is being widely distributed; whether, since the name or names of the authors or printers of this circular are not printed thereon, he is empowered to investigate the matter in order to determine the source of the circular; and whether the issuance of circulars of this nature in this manner during the period prior to the coming Referendum is considered to be in conflict with the Prevention of Electoral Abuses Act, 1923.

My attention has been drawn to this circular which is against Proportional Representation and to another which is in favour of Proportional Representation. I have asked the Commissioner of the Garda Síochána to investigate both cases.

Could the Minister say does the Prevention of Electoral Abuses Act, 1923 deal with referenda?

As far as I know it deals with both elections and referenda.

I have asked officials and they say that it does not.
