Vol. 176 No. 10

Ceisteanna—Questions. Oral Answers. - Legislation on Wills.

17.

asked the Minister for Justice if he will introduce legislation to preclude a solicitor who draws up a will from including himself as one of the beneficiaries.

I am not satisfied that there is any necessity for such legislation but if the Deputy can satisfy me that solicitors' clients are insufficiently protected under the law as it stands I will have the matter examined.

I did submit evidence that people were turned out of their own home by a solicitor who pinched the house of a person whose will he had drawn up. I pointed that out on the Minister's Vote and will bring particulars to his notice.

May I inquire whether it is the intention of the Minister for Justice to consider this matter when presenting the Solicitors Bill to Dáil Éireann which, I assume, is amongst the urgent matters to which he referred in answer to the last question?

That is so but I doubt if the question that Deputy Sherwin has raised comes under that heading and the Deputy did not submit evidence. He made a statement—which is a completely different thing.

No. I qualify that. I said I made a statement here on the Minister's Vote but that I would submit evidence.

Submit the evidence. It is very easy to make statements but we do not get a lot of evidence after the statements.

I have the documents.

Does the Minister appreciate that my supplementary question was ironical in its reference to this matter but factual in its reference to the proximity of the date on which the Solicitors Bill would be introduced?

Question No. 18.
