asked the Minister for Justice if he will state (a) the number of convictions under Section 30 of the Road Traffic Act, 1933, and (b) the number of appeals from such convictions which were successful during the period of five years ended 31st December, 1960; and the number of cases in which district justices suspended the licence endorsement pending the hearing of the appeals during the said period.

The number of convictions in the period from 1st January, 1956, to 30th September, 1960, was 1,182. This figure does not, however, include any figure in respect of the first nine months of 1957 as, owing to changes in the compilation of statistics, no records of convictions were compiled for that period.

The figure given includes cases in which the charge was proved but the Court applied the Probation of Offenders Act.

The other figures asked for by the Deputy are not available and it is doubtful if the results likely to be achieved would be commensurate with the amount of work involved in an attempt to compile them at this stage.

Does the Parliamentary Secretary state that the Probation Act was applied in any case where there was a conviction under Section 30 of the Road Traffic Act?

I have not got that.

The justice cannot do it.
