asked the Minister for Lands whether he is aware that the Land Commission have decided that the road running through the estate at Inchamore, Ballina, Killaloe, County Clare is a county road and that the Land Commission are not responsible for its repair and maintenance; that the Tipperary (N.R.) County Council have never in fact accepted responsibility for the upkeep of this road; and that it was understood by the allottees that the walls of old buildings on the estate were to be used for the repair of the road by the Land Commission; and if in the circumstances the Land Commission will either review their decision and accept responsibility for the repair of the road, or have the county council accept responsibility for it as a county road.

Maintenance of roads is not a function of the Land Commission. The general position is that, where a road made or repaired by the Land Commission for the use and benefit of tenants and allottees is not taken over by the local authority as a public highway, liability for its future maintenance rests with the beneficiaries who may, if necessary, invoke the assistance of the Special Employment Schemes Office.

As regards the particular case in question, however, my information is that this road—which links two county roads—was in existence prior to division of the Hogan estate by the Land Commission in 1958 and had been repaired by the county council.
