asked the Minister for Justice if he will consider the necessity for the provision of a Circuit Court Rule to enable a plaintiff to deliver the defence to a defendant's counter-claim in the Circuit Court having regard, in particular, to the provisions of section 42 of the Civil Liability Act, 1961.

The question of amending the Circuit Court Rules to provide a form of answer to a defendant's counter-claim is being considered in consultation with the Circuit Court Rules Committee.
