asked the Minister for Justice if he is aware that in cases of desertion the maximum sum which a deserted wife can be awarded by the Courts, whether there are children or not, is £4 per week; and whether, in view of the fact that this sum was fixed by the Enforcement of Court Orders Act, 1940, and that in present circumstances it is totally inadequate, he will take steps to introduce legislation to have this maximum payment increased, particularly where there are children to be supported.

I agree that the maximum sum which the District Court may award to a deserted wife is inadequate in present circumstances, particularly where there are children. I have been examining the question of amending legislation on this point for some time.

When introducing the Estimates for my Department earlier this month I indicated that proposals for an extension of the general jurisdiction of the District Court and Circuit Court were being examined. Subject to Government approval the promotion of amending legislation on this matter will provide a suitable opportunity for raising the maximum sum referred to in the question.

I can give no indication at the moment as to when I might be in a position to proceed with the legislative proposals in question but there is a likelihood that I will be ready after the summer recess.
