Vol. 217 No. 7

Ceisteanna—Questions. Oral Answers. - Holidays of Insurance Agents.

58.

asked the Minister for Industry and Commerce the present position regarding the enforcement of holidays provisions against insurance companies in respect of agents employed by them under contracts of or for services; and whether such agents will be given annual holidays this year or pay in lieu thereof.

I have received no complaints about annual holidays from insurance agents employed under a contract of service.

Regarding i n s u r a n c e agents employed under a contract for services, the position is that such agents were brought within the scope of the Holidays (Employees) Act, 1961 by regulations made by my predecessor in 1963. A complaint about failure of an insurance company to grant holidays in accordance with the Act and Regulations was, following investigation by my Department, referred to the Chief State Solicitor's Office with a view to the institution of legal proceedings against the company. I understand that proceedings have been instituted.
