asked the Minister for Local Government if he will state in respect of the Compulsory Purchase Order made in connection with the acquisition of land to provide an access to the large County Council scheme for 152 houses at Swords (a) the date on which the Order was made by the Dublin County Council, (b) the date of the public inquiry, (c) the date of confirmation by him, and (d) if, having regard to the explanation of compulsory purchase procedure mentioned in page 22 of the explanatory memorandum accompanying the Housing Bill, he will explain why the Compulsory Purchase Order concerned was not confirmed in part so as to avoid almost a year's delay in the provision of houses at Swords.

Dublin County Council Compulsory Purchase (Labourers Acts) No. 3 Order, 1964, was made on 1st May, 1964, and it was lodged in my Department on 8th May, 1964. A public local inquiry in relation to the Order was held on 18th and 19th June, 1964, and the Order was confirmed with modifications on 16th February, 1965.

Five sites in various parts of the county were included in this Order. The land which the council proposed to acquire at Swords was comprised of two plots in different ownership and an objection was made to the order in respect of one of these. Objections were also made as respects two of the other sites included in the Order.

The Swords site could not be dealt with separately because the relevant provisions of the Labourers Acts which empower me to deal with a compulsory purchase order in parts are defective in that they require that all the lands included in an order in respect of which objections are made must be dealt with together. Provision to remedy this defect is included in the Housing Bill, 1965.
