asked the Minister for Local Government if he is aware of the unchanged state of dereliction of the open space at Wainsfort Estate, Terenure, Dublin, which has been the source of continuous complaint over a lengthy period by the local residents; and if he will take steps to ensure that the local authority concerned carry out their obligation to the ratepayers there.

I understand that the open space in question has not been completed to the satisfaction of the county council. Before taking the open space in charge they require that the owners carry out certain works. The council recently instituted enforcement proceedings under the Local Government (Planning and Development) Act, 1963, with a view to securing that these works are carried out in accordance with the relevant planning permission.

Is there any indication when the proceedings will bear fruit?

I have not got that information at present but I might be able to get it for the Deputy later.

Does the Minister agree that the new planning legislation is completely ineffective in regard to open spaces being taken in charge by local authorities?

Never has anything gone through this House about which there was not some complaint within a short time afterwards or even while it was going through. I should be a Solomon if I could give an unqualified guarantee in regard to any particular enactment. I cannot give it.

The Act is not as defective as local administration of it.

The undertakings given at the time do not seem to stand up.
