asked the Minister for Local Government if he is aware that Dublin Corporation have received advice from their law agent that the enforcement remedies under the Local Government (Planning and Development) Act, 1963 are not available for many roads owing to the death or insolvency of the developer concerned or to the absence of enforceable conditions in the original provisions; and in the circumstances what steps can be taken to bring such roads up to a proper standard with a view to their being taken in charge by the corporation.

I am aware that conditions may arise, due to altered circumstances, with the passage of time, or to the absence of enforceable conditions in the terms of past planning permissions, in which the provisions in the Local Government (Planning and Development) Act, 1963, by which the completion of estate roads by developers may be enforced, may not be applicable. It is a matter for the local authority to examine the position in such cases and to decide whether, or in what circumstances, they would be prepared to take such roads in charge. I may add that following representations made by me the whole problem of unfinished estates in the Dublin area is under special consideration by the local authorities concerned and that considerable progress has been made in recent months in bringing cases of long standing to a satisfactory conclusion. I make no secret of my view that these efforts must be fully maintained until this problem is resolved in all outstanding cases.
