Vol. 238 No. 8

Ceisteanna—Questions Oral Answers. - Erection of Poultry House.

29.

asked the Minister for Local Government in what circumstances a certificate of exemption may be refused for the building of a poultry house.

I would refer the Deputy to my reply to his question on this subject on the 19th November last.

Can the Minister say if egg production is "agriculture" or whether it comes under the description of "agricultural purposes" in the Act?

Yes, it does.

Would the Minister tell the House why he decided that exemption would not be given for a poultry house in a specific case?

What specific case?

The case of Mr. Wilkinson out on the Swords Road. That was referred to the Minister.

There was the question of a traffic hazard on an arterial road.

There is no such qualification in the description of "exempted development" in the Act. It says nothing about traffic.

It was a question of access to the existing road. It was established that there was no existing access to this road that could be utilised for this proposal. Therefore, there was a proposal to establish a new access to an arterial road.

Is the Minister aware that this man has since got access and got planning permission for it?

I am not.

That is a fact. If it is now referred to the Minister, will he agree that it is exempted?

If it is, it will be dealt with on its merits.

Next question.

This is a very important question.

But it is not the question on the Order Paper.

This question has been referred to the Minister.

The Deputy has not a question down about it today.

With the permission of the Chair, I wish to give notice that I intend to raise the subject matter of this question on the adjournment tonight.

It is not in the South County, is it?

(Cavan): And for that, thanks be to God.

It is not in Dublin South-West.

Then the Minister will give it the hammer.

If he does, he will have Deputy Desmond Foley after him.

Question No. 30.
